Chapter 1 — Terms of Service

Article 1 (Applicability)

These Terms of Service ("Terms") govern your use of Tokyo Yakuza ("Service"). By accessing or using the Service, you agree to be bound by all provisions of these Terms.

Article 2 (Service Overview)

The Service is a Play-to-Earn (P2E) game delivered as a Telegram Mini App. Users can capture virtual territories across Tokyo and earn in-game currency "YZA".

Article 3 (Eligibility)

• The Service is available to users who hold a valid Telegram account.
• Users under 18 must obtain parental or guardian consent before using the Service.
• The paid features (Telegram Stars purchases) are restricted to users who meet the minimum age required by Telegram's Terms of Service in their jurisdiction.
• We reserve the right to refuse or terminate access at our sole discretion, without prior notice.

Article 4 (Accounts)

Your account is tied to your Telegram account. Transfer, sale, or sharing of accounts is prohibited. We are not responsible for any unauthorized access to your account.

Article 5 (Amendments)

We may update these Terms at any time. Changes will be announced in-game or on this page. Continued use of the Service after notification constitutes acceptance of the revised Terms.

Chapter 2 — Payment Policy

Article 6 (Telegram Stars Purchases)

The Service allows you to purchase "Sakazuki" (gacha tokens) using Telegram Stars.

• Purchase and use of Stars is subject to Telegram's Terms of Service.
• Payment processing is handled by Telegram. For payment disputes, contact Telegram Support.
• Purchased Sakazuki can only be used within the Service and cannot be exchanged for cash or cryptocurrency.

Article 7 (YZA-to-Sakazuki Purchases)

You may spend in-game currency YZA to acquire Sakazuki. YZA is not legal tender or cryptocurrency and carries no cash value or refund option.

Article 8 (Gacha & Drop Rates)

Drop rates for each rarity tier are disclosed in-game. Rates are randomized; we do not guarantee the acquisition of any specific character. The pity system (guaranteed high-rarity after a set number of pulls) may be modified without notice.

Chapter 3 — NFT & In-Game Assets

Article 9 (In-Game Currency & Items)

• YZA and Sakazuki will cease to exist upon service termination. No refund or compensation will be provided.
• Item effects and specifications may be changed at any time for balance purposes.

Article 10 (NFT Features)

We plan to introduce NFT functionality for certain characters and items. By using such features, you acknowledge and agree to the following:

• No Value Guarantee: We make no representation regarding the market value, liquidity, or salability of any NFT.
• Not an Investment: NFT acquisition is not an investment. We do not recommend NFTs as a means of financial gain.
• Blockchain Risks: Network outages, smart contract bugs, or wallet loss are outside our control and liability.
• Regulatory Risk: Changes in laws and regulations in your jurisdiction may affect or suspend NFT functionality.
• Tax Obligations: You are solely responsible for any tax liabilities arising from NFT transactions.

Chapter 4 — Prohibited Conduct

Article 11 (Prohibited Actions)

The following actions are strictly prohibited. Violations may result in account suspension and/or legal action:

1. Use of cheats, bots, macros, or modified clients
2. Creating or operating multiple accounts (multi-accounting)
3. Intentional exploitation of bugs or vulnerabilities
4. Harassment, defamation, or abuse of other users
5. Unauthorized real-money trading of in-game currency, characters, or items
6. Interfering with Service operations (e.g., DDoS attacks)
7. Infringing on the intellectual property or privacy rights of third parties
8. Any other conduct we deem inappropriate in our sole discretion

Chapter 5 — Account Management & Bans

Article 12 (Suspension & Permanent Ban)

We reserve the right to suspend or permanently ban an account without prior notice in the following circumstances:

• Violation of Article 11 (Prohibited Conduct)
• Breach of any provision of these Terms
• Activity that significantly harms the Service or other users
• Suspected fraudulent acquisition of YZA, Sakazuki, characters, or items

Upon a ban, all in-game assets associated with the account (YZA, Sakazuki, characters, NFTs, etc.) will be forfeited. No refund or compensation will be issued.

Article 13 (Account Recovery)

Because accounts are tied to Telegram IDs, loss of access to your Telegram account will result in loss of access to your game data. We do not guarantee data recovery under such circumstances.

Chapter 6 — Service Changes & Termination

Article 14 (Modification & Discontinuation)

We may modify, suspend, or permanently terminate the Service at any time for technical, business, or external reasons.

We will make reasonable efforts to notify users in advance via Telegram or in-game announcements. In urgent situations, the Service may be suspended without prior notice.

Chapter 7 — Disclaimer

Article 15 (Disclaimer of Warranties)

The Service is provided "as is" and "as available." We make no warranties, express or implied, including but not limited to:

• Uninterrupted or error-free operation
• Freedom from bugs, defects, or security vulnerabilities
• Preservation of game data or progress
• Monetary value of in-game currency or NFTs
• Maintenance of specific game balance or character performance

Article 16 (Limitation of Liability)

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service (including but not limited to lost profits, data loss, or emotional distress). Where applicable law does not permit full exclusion of liability, our total liability shall not exceed the amount you actually paid us for Stars-based purchases in the one (1) month preceding the claim.

Article 17 (Third-Party Services)

The Service depends on third-party platforms including Telegram and blockchain networks. We are not liable for damages arising from outages, policy changes, or termination of such third-party services.

Article 18 (Not Investment Advice)

The Service is provided for entertainment purposes only. Nothing in the Service constitutes financial, investment, or gambling advice. We make no representation that any in-game activity will result in financial gain.

Chapter 8 — Privacy Policy

Article 19 (Data We Collect)

We collect and store the following information:

• Telegram User ID: Used to identify your account
• Display Name & Avatar: As configured by you in-game
• Game Data: YZA balance, characters, territories, battle records, etc.
• Payment Records: Stars purchase history (amount, date, package). Card numbers and payment credentials are handled exclusively by Telegram and are never transmitted to us.
• Log Data: Access timestamps and action logs for anti-cheat purposes

Article 20 (How We Use Your Data)

• Providing and maintaining the Service
• Detecting and preventing fraudulent activity
• Improving game balance through aggregate analysis
• Sending important service notifications

Article 21 (Third-Party Disclosure)

We do not sell or share your personal information with third parties, except in the following cases:

• Where required by applicable law or legal process
• Where you have given explicit consent
• Where NFT minting results in wallet address and asset data being recorded on a public blockchain

Article 22 (Data Retention & Deletion)

Game data is retained for the duration of the Service. To request account deletion, contact us via the in-game support channel or Telegram Bot. We will erase your data within 30 days of receiving the request, except where retention is required by law.

Article 23 (Cookies & Tracking)

As the Service operates within the Telegram Mini App environment, we do not set independent cookies. Telegram's own data practices are governed by Telegram's Privacy Policy.

Chapter 9 — Governing Law, Jurisdiction & Contact

Article 24 (Governing Law)

These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law provisions.

Article 25 (Jurisdiction)

Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
